1. Parties and Scope
These Terms of Use (the “Terms”) are entered into between you and 甘论兵, an individual developer (the “Developer”). They apply to the iOS application Quality Sleep (the “App”) provided by the Developer, including its interfaces, software, audio, video, text, and related features.
These Terms are solely between you and the Developer. Apple Inc. (“Apple”) is not a party to them. Your use of the App Store, an Apple ID, an Apple device, or purchase and subscription services provided by Apple is also subject to the then-current Apple Media Services Terms and Conditions, App Store Usage Rules, and Apple's Licensed Application End User License Agreement. Mandatory law and non-excludable Apple platform rules prevail.
This page supplements Apple's standard Licensed Application End User License Agreement. It does not replace that agreement and is not submitted as a custom end-user license agreement in App Store Connect. If the Developer adopts a custom agreement in the future, the Developer will update the applicable terms and provide the required information.
2. Eligibility and Minors
The App is offered to users of all ages, but it is not designed specifically for children and does not provide social-interaction features, user-generated content, or public-interaction features.
- If you have full legal capacity under applicable law, you may agree to and comply with these Terms yourself.
- If you are under 18, or otherwise lack full legal capacity where you live, a parent or legal guardian must read and agree to these Terms and supervise your use.
- A child under 14 must use the App with a guardian present. Device settings and App Store purchases or subscriptions must be operated or confirmed by the guardian.
- Guardians must set reasonable limits on duration, volume, and nighttime device use in view of the child's age and physical condition.
3. Service and Offline Operation
The App primarily provides local relaxation and sleep-support features, including:
- playing white noise, nature sounds, relaxing ambient sounds, and other sleep-support audio supplied with the App;
- displaying and looping scene videos supplied with the App;
- browsing audio by category, searching locally, saving favorites, and adjusting scene volume and video playback settings;
- locally managing priority between scene audio and audio you start, based on the current scene and playback state; and
- playing audio in the background where permitted by the system and your settings.
4. License
Subject to your compliance with these Terms, the Developer grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use the App solely for personal, non-commercial purposes on Apple-branded devices that you own or control, in accordance with the Usage Rules in the Apple Media Services Terms and Conditions. Uses permitted under Apple's Family Sharing or volume-purchasing rules are not restricted by this sentence.
Except for the limited license expressly granted here, all rights in the App and its content are reserved by the Developer or the applicable rights holder.
5. Rules of Use
You must not do, or help anyone else do, any of the following, except to the extent applicable law expressly permits the activity and does not allow it to be restricted by contract:
- copy, sell, rent, sublicense, publicly distribute, commercially exploit, or extract content from the App in bulk;
- reverse engineer, decompile, circumvent technical protections, interfere with normal operation, or bypass App Store purchase or entitlement verification;
- remove or alter copyright, trademark, attribution, licensing, or other proprietary notices;
- use the App for unlawful or harmful activities, to infringe another person's rights, or in breach of an applicable third-party agreement; or
- play audio in a manner that may harm a device, hearing, personal safety, or another person's ordinary activities.
6. Intellectual Property and Third-Party Content
The App's source code, interface design, arrangement, text, graphics, and content created by the Developer are protected by applicable intellectual-property laws. Some audio, video, open-source software, or other materials in the App may be provided by third-party rights holders and remain subject to their respective license terms.
Metadata for some bundled audio identifies the Pixabay Content License, and metadata for some videos includes Pixabay source pages. The relevant source records and applicable licenses determine the specific scope of rights. For third-party content with an identified source or license, the applicable license and rights notice control. These Terms do not transfer ownership of third-party content to you or restrict rights already granted to you by an open-source license or mandatory law.
7. App Store Purchases, Free Trials, and Auto-Renewing Subscriptions
This section applies only if the version of the App distributed to you actually offers paid features. Available products, prices, currencies, subscription periods, free-trial eligibility, and included benefits are shown in the App Store purchase confirmation interface. If information in the App differs from Apple's purchase confirmation, the Apple confirmation controls.
- All purchases of iOS digital content are processed through Apple's in-app purchase system. The Developer does not directly receive your full payment-card details or Apple ID password.
- If an auto-renewing subscription is offered, it renews at the end of each subscription period unless you turn off auto-renewal at least 24 hours before the current subscription or free-trial period ends.
- If a free trial is offered, eligibility is determined by Apple and the applicable offer rules. At the end of the trial, the subscription renews at the displayed price unless canceled in time.
- You can manage or cancel a subscription in iOS under Settings > Apple Account > Subscriptions. Deleting the App does not cancel a subscription.
- Purchase restoration, billing, refunds, and disputes are governed by Apple's rules and applicable consumer-protection law. If a product is restorable, the App will provide a “Restore Purchases” function. You may also contact Apple Support.
- A purchase made with an Apple ID does not create an account within the App. Entitlements may be restored on devices associated with the same purchasing account, subject to Apple's rules.
The benefits and ongoing content included with an auto-renewing subscription are described on the purchase page and should meet Apple's ongoing-value requirements. The Developer will clearly explain the content or functionality available before purchase. If your version of the App does not enable real App Store purchases, this section creates no payment obligation.
8. Health and Safety
- If you have persistent sleep problems, hearing concerns, or mental or physical discomfort, consult a qualified physician or other professional.
- Stop using the App immediately if you experience discomfort. In an emergency, contact your local emergency services and do not rely on the App.
- Use a safe volume, avoid prolonged headphone use, and do not use attention-reducing content while driving, operating equipment, or when you must remain alert.
- Do not make medical decisions solely on the basis of App content or delay professional care because of the App.
9. Updates, Availability, and Changes to the Service
The Developer may update, modify, add, or remove features and content to improve the experience, fix issues, maintain operating-system compatibility, or comply with legal and platform requirements. Updates may be provided through the App Store and are subject to your device settings and Apple's rules.
The Developer will use reasonable efforts to maintain the App but does not guarantee that it will be uninterrupted, error-free, compatible with every device or system version, or permanently available. Features already downloaded to a device may be affected by system upgrades, device limitations, damaged resources, or changes in content rights.
10. Maintenance, Warranties, Claims, and Limitation of Liability
To the maximum extent permitted by applicable law, the App is provided “as is” and “as available.” The Developer does not guarantee any particular sleep-related outcome, that the content is suitable for every user, that the App is completely error-free, or that it is compatible with all hardware and software. Consumer rights, statutory warranties, and remedies that cannot lawfully be excluded remain unaffected.
The Developer, not Apple, is responsible for maintenance and support of the App and for addressing claims relating to product liability, legal or regulatory compliance, consumer protection, privacy, or intellectual property. Apple has no obligation to provide maintenance or support for the App.
If the App fails to conform to an applicable warranty, you may notify Apple in accordance with Apple's rules. Where applicable, Apple may refund the purchase price of the App. To the maximum extent permitted by law, Apple has no other warranty obligation. The Developer is responsible, within the scope required by applicable law, for other claims attributable to a failure to conform to a warranty.
To the maximum extent permitted by applicable law, the Developer is not liable for indirect, incidental, or consequential losses caused by misuse, device failure, events beyond the Developer's reasonable control, or your failure to comply with these Terms. No limitation applies to liability that cannot legally be limited, and nothing in these Terms reduces rights you have under applicable law.
11. Suspension and Termination
You may stop using and delete the App at any time. If you materially breach these Terms, the Developer may terminate your license to the extent permitted by law. When the license ends, you must stop using the App. Provisions that by their nature should survive, including those concerning intellectual property, liability, dispute resolution, and Apple's third-party-beneficiary rights, will remain in effect.
Uninstalling or deleting the App does not automatically cancel an active App Store subscription. You must cancel any subscription through Apple's subscription-management interface.
12. Privacy
For information about how the App handles local preferences, purchase information, and information you provide when you contact the Developer, see the Quality Sleep Privacy Policy. The Privacy Policy forms an important part of these Terms.
13. Changes to These Terms
The Developer may update these Terms to reflect changes in the App, applicable law, or platform rules and will update the “Last updated” date on this page. If a change materially affects your rights or obligations, the Developer will provide notice through an in-app notice, release notes, or another reasonable method where required by law.
By continuing to use the App after updated Terms take effect, you accept the updated Terms. If you do not agree, you must stop using the App. The Developer will prominently identify terms concerning auto-renewal, limitations of liability, or other matters that materially affect your interests, and will obtain your express consent again where required by law. Mandatory law prevails.
14. Governing Law and Dispute Resolution
These Terms and the legal relationship between you and the Developer are governed by the law determined under applicable choice-of-law rules, without excluding consumer-protection, privacy, or other mandatory rules in your place of residence that cannot be waived by agreement. The parties should first attempt to resolve any dispute arising from these Terms or the App through good-faith discussions. If no resolution is reached, either party may bring proceedings before a court with lawful jurisdiction.
This section does not prevent a consumer from asserting rights in the courts or other competent bodies of the consumer's place of residence where mandatory law so permits.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect. A delay by the Developer in exercising a right does not waive that right. Section headings are for convenience only and do not affect interpretation.
15. Apple-Specific Terms
- You acknowledge that these Terms are concluded solely between you and the Developer, not with Apple, and that the Developer is responsible for the App and its content.
- You must comply with applicable third-party agreements when using the App, including the Apple Media Services Terms and Conditions and lawful-use rules for your device and network service.
- You represent that you are not located in a country or region subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple has the right to enforce the Apple-related provisions against you as a third-party beneficiary.
